RE: The tariff classification of a ceramic bowl set from China.

Dear Mr. Akarsu:

In your letter dated September 16, 2008, you requested a tariff classification ruling.

The merchandise under consideration is a 5 Piece Ceramic Bowl Set. The bowls are made of stoneware and are in different colors. They measure 9.5” x 6”, 8.25” x 5.25”, 7” x 4.5”, 6” x 4”, and 5.5” x 3.5”. In a telephone conversation with this office, you indicated that the bowls will be for use with food. You have submitted a photograph of the bowls with your request.

The applicable subheading for the 5 Piece Ceramic Bowl Set will be 6912.00.4810, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Ceramic tableware, kitchenware, other household articles and toilet articles, other than of porcelain or china: Tableware and kitchenware: Other… Suitable for food or drink contact.” The rate of duty will be 9.8% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
